CANCELLATION AND REFUND TERMS:
I. PAYMENTS
A) At the time of registration, at least 35% of the reservation fee must be paid, and the remaining balance must be paid at least 3 days before the trip begins. If the specified payments are not made within these periods, the reservation will be canceled, and 35% of the fee will be invoiced to the consumer as cancellation compensation.
B) Consumers who purchase discounted services are obliged to pay the full service fee on the date of reservation.
C) For special products and services, the balance must be paid at least 60 days before the service begins. The cancellation compensation is the same as in Section I/A.
D) For day trips, the full tour fee is collected at the time of registration, and there is no pre-reservation.
II. CANCELLATION-TRANSFER
1) The agency may cancel or postpone the trip if the required number of confirmed registrations for the trip has not been met despite exercising all due diligence, and/or due to adverse weather conditions, roadblocks, strikes, terrorism, fog, war, war risks, unforeseeable technical issues, and all force majeure events. In this case, the consumer has no right to compensation.
2) A) If the consumer requests cancellation of the service 15 days before the start of the service, the full amount paid will be refunded.
B) If the consumer requests cancellation 15 days before the start of the service, they will be refunded the full amount. If they cancel the contract 15-7 days before the service begins, they agree and promise to pay 35% of the trip cost, and if the cancellation is less than 7 days before the start of the service, they agree to pay the full amount to the agency. Date changes made by the consumer are considered a cancellation (the date change is at the company's discretion).
C) In the case of the cancellation/transfer of discounted services, the consumer agrees and commits to pay 35% of the service fee if canceled between 15-7 days before the start of the service, and to pay the full service fee if canceled less than 7 days before.
D) In the case of cancellation and refund processes for cruise tours, the cancellation and refund conditions of the shipping company apply. Accordingly, for cruise travel, cancellations made up to 77 days after the confirmation of the reservation incur a fee of 100 Euro per reservation; cancellations made between 76-60 days incur 25% of the reservation amount; cancellations made 59-45 days before incur 40%; 44-31 days before incur 60%; 30-21 days before incur 80%; and cancellations made 20-0 days before incur 100% cancellation fee. In air packages, the airline's cancellation conditions apply according to the status of the canceled flight ticket.
E) The consumer's cancellation/transfer of the service due to illnesses or deaths of themselves or first-degree relatives that prevent regular occupation for 10 days, must be documented with an official report from a state hospital presented in writing before the start of the service, which is an exception to the cancellation/transfer provisions.
3) The consumer can transfer the tour to another person up to 7 days before the start of the service, provided they notify the agency in writing. The transferee is jointly responsible with the transferor for all expenses incurred due to the pending balance and transfer.
4) If the consumer fails to notify in writing that they will not participate in the service they missed the start of, the agency has the right to cancel all reservations and services made in the name of the consumer after 24 hours. No refund will be made in such cancellations.
5) The agency reserves the right to partially or completely cancel the trips it announces or registers, with prior notification to the consumer, before the start of the trip. During the same period, the names of hotels included in the tour, means of transport, and the locations specified in the program can be changed.
6) In cases of cancellation and changes in air travel, the airline's conditions apply. Promotional tickets cannot be canceled or changed. Promotional tickets are valid with hotel reservations. In the cancellation of hotel reservations, the total payment amount will be deducted from the entire plane ticket.
7) Guests are required to be at the airport at least 1.5 hours before domestic flights and at least 2 hours before international flights. Identification is required for domestic flights, and passports for international flights (transactions will be conducted according to the names specified on these documents). A driver's license cannot be used instead of identification for flights.
8) For accommodation tours, the cancellation compensation is the same as in II/1) A, 48 hours before the tour begins. The agency may cancel or postpone the trip due to a lack of the necessary number of confirmed registrations despite demonstrating all due diligence, adverse weather conditions, roadblocks, strikes, terrorism, fog, war, war risks, unforeseeable technical matters, and all force majeure circumstances. In this case, the consumer has no right to compensation.
9) For day trips, the cancellation compensation is the same as in II/1) A, 12 hours before the tour starts. The agency may cancel or postpone the trip due to a lack of the necessary number of confirmed registrations despite demonstrating all due diligence, adverse weather conditions, roadblocks, strikes, terrorism, fog, war, war risks, unforeseeable technical issues, and all force majeure events. In this case, the consumer has no right to compensation.
III. GENERAL PROVISIONS
1) All responsibility regarding luggage and its contents belongs to the owner. The consumer is obliged to comply with the laws and customs applicable to the vehicle they will travel in and the establishment where they will stay.
2) In cases of loss or damage to luggage due to the service provider’s gross negligence; if the consumer has a loss or damage report prepared, the agency will pay the consumer half of the total travel value corresponding to the transport component of the trip for all items in the luggage without regard to their monetary or moral value and other characteristics. The agency is liable for any loss, damage, and theft of items declared in writing, with their values reported, only up to the travel cost.
3) VISA PROCEDURES and SERVICES are not included in the purchased service. If requested, the agency can assist its guests with application processes for visa procedures at their cost. The agency is not responsible for any issues that arise during the visa application process, as the parties in question are the traveller and the consulate.
4) The agency is responsible for causes other than force majeure events, those for which the consumer is responsible, and those arising from the personal liability of third parties after the service has commenced. In situations where the agency is liable, it may compensate the consumer through a refund of costs or services according to the provisions of the TÜRSAB Kütahya Scale or through additional or alternative arrangements that do not include extra costs that occur during the trip. Accepting and using such additional services cancels the rights to refunds and damages.
5) The consumer undertakes to comply with the rules communicated by the guide, the establishment, the agency, and the transportation officials regarding the service purchased; to respect third parties' lives, property, and peace; otherwise, they accept that they will not be entitled to the service for just cause and that there will be no right of refund.
6) If the consumer leaves the trip claiming that the service rendered was defective, they must notify the agency official from whom they purchased the trip and the hotel in writing, specifying the reasons. Otherwise, the consumer will not be deemed to have left the trip and will be considered to have used and benefited from the service.
7) It is a goodwill consumer's obligation to report any complaints to the agency in writing during the execution of the service.
8) Consumers who are not signatories of the contract but participate in the service subject to the contract are deemed to have accepted and committed to the provisions of this contract once they have had the consumers they designated read and sign this contract. The agency retains the right to recourse for any excessive amounts paid or any service fees from consumers who signed the contract.
9) In accordance with Article 12 of Law No. 1618; if a package tour service is purchased, the coverage for the inadequacy or non-delivery of the package tour is guaranteed through insurance. The coverage is limited to the amount of the package tour fee.
10) For tours departing from abroad, by law, a notarized consent letter must be obtained from the parent accompanying the child under 18 traveling separately from either one of their parents, and they must travel with this document.
11) The consumer has the right to cancel within (7) days of the validity of this agreement by notifying the agency in writing and submitting the original tour registration forms for the performance of the service. Within 10 days following the receipt of these documents, the service fee will be refunded to the consumer. If the original invoice is not submitted, VAT and other legal obligations will not be refunded.
12) In the event of the agency failing to comply with the contract partially or completely, the provisions of the TÜRSAB Kütahya Scale will be applied in calculating the compensation to be paid.
13) The consumer declares that they have read and understood all preliminary information regarding the nature of the service, sale price, payment method, and performance of the service, and that they have provided the necessary confirmation electronically.
THESE TERMS HAVE BEEN READ, UNDERSTOOD, AND ACCEPTED BY THE CONSUMER(S) RECEIVING THE SERVICE, WHO HAVE ALSO RECEIVED A COPY OF THIS CONTRACT.

8) For cruise tours, an additional cruise tour agreement will be signed with this contract.
9) DISPUTES AND Jurisdiction
The parties agree that Turkish law will apply to any disputes arising from the application and interpretation of this Contract, and that the Bolu Courts and Execution Offices shall have jurisdiction.
